Terms of Service

These Terms of Service ("Terms") govern your use of the Androcrew platform at chat.androcrew.com (the "Service"), operated by Androcrew ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

Androcrew is an AI-powered personal assistant platform that uses generative artificial intelligence and large language models to help you with tasks including research, scheduling, communication, financial analysis, and more. The Service operates through specialized AI "crews," each designed for a specific domain.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

3. Account Registration

• You must create an account to use the Service.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate information and keep it up to date.
• Notify us immediately if you suspect unauthorized access to your account.

4. Subscriptions and Payments

4.1 Plans

The Service offers multiple subscription tiers (Free, Personal, Personal Pro, Business, Business Pro) with varying usage limits and features. Current pricing and plan details are available on the Service.

4.2 Billing

• Paid subscriptions are billed on a recurring basis (monthly or annually) through Stripe.
• You authorize us to charge your payment method for the applicable subscription fees.
• Prices may change with 30 days' notice.

4.3 Usage Limits

• Each subscription tier includes a monthly task/token allocation.
• You will receive warnings at 80% and 90% of your usage limit.
• Exceeding your limit may result in temporary service restrictions until your next billing cycle.

4.4 Cancellation and Refunds

• You may cancel your subscription at any time through your account settings.
• Cancellations take effect at the end of the current billing period.
• We do not provide prorated refunds for unused portions of a billing period.
• Upon cancellation, your account will revert to the Free tier.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights
• Generate, store, or distribute illegal, harmful, abusive, or harassing content
• Attempt to extract, reverse-engineer, or replicate the AI models used by the Service
• Circumvent usage limits, rate limits, or access controls
• Use the Service to build a competing product or service
• Impersonate any person or entity
• Transmit malware, viruses, or other harmful code
• Interfere with or disrupt the Service or its infrastructure
• Use automated means to access the Service beyond the provided API, except as authorized
• Share your account credentials with others

We reserve the right to suspend or terminate accounts that violate these terms.

6. AI-Generated Content

6.1 No Professional Advice

AI-generated content does not constitute professional advice of any kind, including but not limited to legal, medical, financial, tax, or investment advice. Always consult qualified professionals for important decisions.

6.2 Accuracy

We do not guarantee the accuracy, completeness, or reliability of any AI-generated content. Large language models can produce outputs that appear confident but are factually incorrect ("hallucinations").

6.3 Financial Features

Any financial analysis, trading insights, budgeting suggestions, or investment-related outputs are for informational purposes only. They are not recommendations to buy, sell, or hold any security or financial instrument. Past performance does not guarantee future results. You bear all risk for financial decisions made based on Service outputs.

6.4 Autonomous Actions

Certain features allow the Service to take actions on your behalf (e.g., sending emails, making phone calls, scheduling events). You acknowledge that:

• You are responsible for configuring and authorizing these actions.
• Actions taken by the AI on your behalf are treated as your actions.
• We are not liable for consequences of autonomous actions you have authorized.

7. Your Content

7.1 Ownership

You retain ownership of all content you provide to the Service (messages, files, data). You grant us a limited, non-exclusive license to process your content solely for the purpose of providing the Service to you.

7.2 AI Outputs

To the extent permitted by law, you own the AI-generated outputs produced in response to your inputs. We make no claim of ownership over AI-generated content. However, similar or identical outputs may be generated for other users providing similar inputs.

7.3 Feedback

If you provide feedback or suggestions about the Service, we may use them without obligation to you.

8. Connected Third-Party Services

• The Service allows you to connect third-party accounts (Google, financial institutions, etc.).
• By connecting these accounts, you authorize us to access and use data from these services as described in our Privacy Policy.
• Your use of third-party services is also governed by their respective terms and policies.
• We are not responsible for the availability, accuracy, or actions of third-party services.
• You may disconnect third-party accounts at any time through your account settings.

9. API Access

• The Service may provide API keys for programmatic access.
• API keys are subject to the same usage limits as your subscription tier.
• You are responsible for securing your API keys. Treat them as passwords.
• We may revoke API keys that are used in violation of these Terms.

10. Intellectual Property

The Service, including its design, software, models, and documentation, is owned by Androcrew and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand elements.

11. Disclaimers

Without limiting the foregoing, we do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• AI-generated content will be accurate, complete, or appropriate
• The Service will meet your specific requirements
• Defects will be corrected in a timely manner
• Third-party integrations will remain available or function correctly

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANDICREW AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

This limitation applies regardless of the theory of liability (contract, tort, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

13. Indemnification

You agree to indemnify, defend, and hold harmless Androcrew and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Actions taken by the Service on your behalf that you authorized
• Content you provide to the Service

14. Termination

• You may stop using the Service and close your account at any time.
• We may suspend or terminate your access if you violate these Terms, with or without notice.
• Upon termination, your right to use the Service ceases immediately.
• Sections that by their nature should survive termination (Disclaimers, Limitation of Liability, Indemnification) will survive.

15. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after changes constitutes acceptance of the modified Terms. If you disagree with any changes, you must stop using the Service.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Harris County, Texas.

17. General Provisions

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Androcrew regarding the Service.
• Severability: If any provision is held unenforceable, the remaining provisions remain in effect.
• Waiver: Our failure to enforce any provision does not constitute a waiver of that provision.
• Assignment: You may not assign your rights under these Terms. We may assign ours without restriction.
